The East African Court of Justice (EACJ) on Wednesday adjourned a case filed against the East African Community secretary general and the governments of Uganda, Rwanda and Kenya over the exclusion of Tanzania and Burundi in regional meetings.

The Court found that the applicants had provided insufficient material for the Court to make a decision and therefore adjourned the matter to be heard in February 2014 after filing more documents and serving all the respondents.

The application was filed by three Tanzanian nationals Ally Hatibu Msanga, David Geoffrey Makatha and John Adam Mwenda, all residents of Arusha.

They are seeking the ex-parte orders against the EAC secretary general, Uganda, Rwanda and Kenya from holding meetings in exclusion of Tanzania and Burundi pending the hearing and determination of the main case.

The Applicants are also asking the Court to restrain the respondents from consummating resolutions arrived at in their meetings of June 24 to 25 in Entebbe, August 28 in Mombasa and October 28 in Kigali pending the hearing and determination of the application of inter parties.

The Court also told the applicant to file all the necessary documents in English which is the official language of the Community since all documents in support of the matter were in the Kiswahili and had not been translated in accordance with Article 137 of the EAC Treaty.

Counsel for the applicants Jimmy Obedi submitted that the application was brought to Court under Rules 73 (1 & 2) of the East African Court of Justice.
